Introduction and General InformationThese Terms of Use apply to your use of our website. Before using our website you must agree to these Terms of Use. EasyOHS Pty. Ltd. may change these Terms of Use from time to time and by continuing to use our website you accept and agree to be bound by all changes.
DELIVERY POLICY
The free demonstration software is available by download at any time, directly from this website.
Initial Purchase:
If you purchase a membership then you may download the software immediately and the key to enable full activation will be sent to you, by email, when the payment is cleared.
Following that, you will be sent a cd with the key and the free general induction movie for safe keeping. The cost of that delivery is included in the purchase price.
Free Updates:
Free updates are available for download at anytime but, should you want those updates delivered on cd there will be a nominal charge, for labour, time and materials, added to your next invoice.
Refund Policy : Software Items
This product is available for evaluation at no cost to the end user so once an item has been purchased and the unlock code has been given to the customer it is considered unreasonable to claim the product does not satisfy the End User needs. The standing policy on our software products is that there are no refunds available once the unlock code has been *exposed to the user.
Generally, for a software item, you will only be entitled to a refund if all of the following apply:
If all of the above apply and we cannot satisfy your initial order, a refund will be issued.
- The software is found to be defective and cannot be installed on a computer utilising the XP, Vista or Windows 7 operating systems.
- Once a defect is found our technical support staff cannot provide a fix within twenty-one (21) days.
- the unlock code has not been sent to the user.
(*The unlock code is considered exposed to the user once the disc on which we installed it or the email to which we attached it has been dispatched from EasyOHS)
Policy, Procedure and SWP templates (including Downloads)
Templates provided by EasyOHS are general guides only and are not legally binding documents. EasyOHS templates do not purport to cover all the requirements of any relevant legislation, codes or standards that may be associated or required for the activity being undertaken.
Employers have a responsibility to consult, on work health and safety matters with any health and safety representative for a work group / or workers carrying out work for the business or undertaking.
By reading these terms of use you agree that:
a) You understood this notice and your duties to consult with employees in developing procedures (including policies, work methods, and safety / risk analysis).
b) That any document templates provided by EasyOHS must be reviewed (updated where required) and accepted for use in the specific work environment where they are to be used.
If for any reason you are not completely satisfied with your purchase we will give you a full 30 day money-back guarantee from the time you receive the goods.
Please email us at support@easyohs.com.au within that time if you are not satisfied with your purchase so that we can resolve any problems.
This refund policy does not apply to goods which have been worn or used, damaged after delivery, or if any attempt has been made to alter the product or if they have been dropped or broken. All products must be returned in their original condition. All postage and insurance costs are to be paid by the buyer. We recommend that you return the product via Registered post and that you pre pay all postage. You assume any risk of lost, theft or damaged goods during transit & therefore advise you take out shipment registration of insurance with your postal carrier. EasyOHS Pty Ltd will not be responsible for parcels lost or damaged in transit if you choose not to insure.
Intellectual Property Rights
All copyright, trade marks, design rights, patents and other intellectual property rights (registered and unregistered) in and on our website and all content (including any applications) located on the site shall remain the sole property of EasyOHS Pty. Ltd. or its licensors (which includes other users).
What we consider acceptable use of our website
You agree to use our website only for lawful purposes, and in a way that does not infringe the rights of, restrict or inhibit anyone else's use and enjoyment of the website. Prohibited behaviour includes harassing or causing distress or inconvenience to any other user, transmitting obscene or offensive content or disrupting the normal flow of dialogue within our website.
You must not use our website to send unsolicited commercial communications.
You must not use the content on our website for any marketing related purpose without our express written consent.
Restricted Access
We have restricted access to certain areas of our website. We may in the future need to restrict access to parts (or all) of our website and reserve full rights to do so. If, at any point, we provide you with a username and password for you to access restricted areas of our website, you must ensure that both your username and password are kept confidential.
We also reserve the right to disable your user account at our sole discretion without explanation.

EasyOHS Pty. Ltd. do not warrant that functions available on the website will be uninterrupted or error free, that defects will be corrected, or that the server that makes the website available is free of viruses and / or bugs. You acknowledge that it is your responsibility to implement sufficient procedures and virus checks (including anti-virus and other security checks) to satisfy your particular requirements.

Without prejudice to our other rights under this terms of use, if you fail to abide by these terms of use when using our website, we will take all necessary measures to ensure our protection including, but not limited to, informing relevant third parties such as your employer or internet provider about the infringement(s). We will also inform law enforcement on any serious violation.
