BHP and a subcontractor fined over fatal accident at WA

Mining giant BHP and a sub-contractor have been fined for a fatal workplace accident in Western Australia's North West.

Paul Sparkes, 29, was struck by a tyre from a dump truck while working at BHP's Yandi mine, near Newman, in 2008.

The Perth Magistrates Court heard Mr Sparkes and another worker were fitting the tyre without the proper training.

The Magistrate found it was not a case of a blatant disregard for safety, but more a system failure that had dire consequences.

BHP was fined $102,000 and sub-contractor HWE Newman Services, which was found to have prime responsibility for the incident, was fined $136,000.

Mr Sparkes' family had called for harsher penalties but says they are glad the matter is finally over.
